Terms and Conditions

These Terms and Conditions (hereinafter "Terms") regulate the use of the website and the Web-App "Pozzallo Nata sul Mare - The city in a palm" (hereinafter "Platform"), technically managed by IMMAGINA ADV on behalf of the Municipality of Pozzallo.

1. User Requirements and Access to the Services

Use of the Platform is permitted to users of all ages. However:

  • Purchases and Registration: To make purchases in the events section or to register for restricted areas, the user must be 18 years of age or act under the supervision of an adult.

  • Acceptance: By using the Platform, you represent that you have the legal capacity to accept these Terms.

2. Intellectual Property and Copyright

All the material on the Platform (texts of the Pozzallo 2026 Dossier, logos, CityHand software, photographs, videos and graphics) is the exclusive property of the Municipality of Pozzallo or of IMMAGINA ADV.

  • Restrictions: It is prohibited to copy, modify, distribute or use the contents for commercial purposes or to favor projects in competing territories without written authorization.

  • Copyright: Any violation of intellectual property will be prosecuted pursuant to Law 633/1941.

3. Modification of the Offer and Services

The Municipality of Pozzallo reserves the right to:

  • Change, suspend or discontinue any service or feature of the Web-App (e.g. guided routes, access to areas of the Logbook) at any time and without notice.

  • Update the rates for paid events, ensuring that the price applied is the one indicated at the time of purchase.

4. Payments and Transactions (Events Section)

To purchase tickets or services via the Platform:

  • Payment Methods: The main circuits are accepted (Credit/Debit Cards, PayPal, Stripe) managed through secure encrypted systems.

  • Responsibility: The user guarantees that he is the owner of the payment method used.

  • Confirmation: The purchase is confirmed only after sending the receipt email containing the entry ticket.

5. Suspension and Cancellation of Accounts

We reserve the right to permanently suspend or cancel a registered user's or member's access, without notice, if:

  • These Terms are violated.

  • The user uses the Platform for illicit or harmful activities for the image of the city of Pozzallo.

  • There are attempts at computer intrusion (hacking) into the Web-App databases.

6. Warranties and Limitation of Liability

  • Warranties: The Platform is provided "as is". Although IMMAGINA ADV guarantees basic assistance for system recovery, the service is not guaranteed to be free of temporary interruptions due to third-party suppliers (Wix, Aruba).

  • Contents: Information about the events is provided by the organizers. The Municipality is not responsible for inaccuracies or program changes not promptly communicated.

  • Mobile Use: The user is responsible for the use of the device during pedestrian or road navigation via the Web-App.

7. Indemnity

The user agrees to indemnify and hold harmless the Municipality of Pozzallo and IMMAGINA ADV from any request for compensation, loss or damage (including legal fees) arising from improper use of the Platform or violation of these Terms.

8. Dispute Resolution (ODR) and Competent Court

In compliance with EU rules, consumer users can use the ODR (Online Dispute Resolution) platform for disputes related to online purchases: http://ec.europa.eu/consumers/odr/. Any legal dispute will be subject exclusively to Italian law and the jurisdiction of the Court of Ragusa.
