Terms and Conditions

These Terms and Conditions (hereinafter "Terms") govern the use of the website and the Web-App "Pozzallo Nata sul Mare - La città in un palmo" (hereinafter "Platform"), technically managed by IMMAGINA ADV on behalf of the Municipality of Pozzallo.

1. User Requirements and Access to the Services

Use of the Platform is permitted to users of all ages. However:

  • Purchases and Registration: To make purchases in the events section or to register for restricted areas, the user must be 18 years of age or act under the supervision of an adult.

  • Acceptance: By using the Platform, you represent that you have the legal capacity to accept these Terms.

2. Intellectual Property and Copyright

All material on the Platform (texts of the Pozzallo 2026 Dossier, logos, CityHand software, photographs, videos and graphics) is the exclusive property of the Municipality of Pozzallo or IMMAGINA ADV.

  • Restrictions: Copying, modifying, distributing, or using the content for commercial purposes or to support competing projects is prohibited without written permission.

  • Copyright: Any violation of intellectual property will be prosecuted pursuant to Law 633/1941.

3. Modification of the Offer and Services

The Municipality of Pozzallo reserves the right to:

  • Change, suspend, or discontinue any service or feature of the Web App (e.g., guided tours, access to Logbook areas) at any time and without notice.

  • Update the prices of paid events, ensuring that the price applied is the one indicated at the time of purchase.

4. Payments and Transactions (Events Section)

To purchase tickets or services through the Platform:

  • Payment Methods: All major payment methods (Credit/Debit Cards, PayPal, Stripe) are accepted, managed via secure encrypted systems.

  • Responsibility: The user guarantees that he is the owner of the payment method used.

  • Confirmation: The purchase is confirmed only after the receipt email containing the admission ticket has been sent.

5. Suspension and Cancellation of Accounts

We reserve the right to suspend or permanently cancel the access of a user or registered member, without notice, if:

  • These Terms are violated.

  • The user uses the Platform for illegal activities or activities that are harmful to the image of the city of Pozzallo.

  • There are attempts at computer intrusion (hacking) into the Web-App databases.

6. Warranties and Limitation of Liability

  • Warranties: The Platform is provided "as is." While IMMAGINA ADV guarantees basic system recovery support, it does not guarantee that the service will be free from temporary interruptions due to third-party providers (Wix, Aruba).

  • Contents: Event information is provided by the organizers. The Municipality is not responsible for inaccuracies or program changes not communicated promptly.

  • Mobile Use: The user is responsible for using the device while navigating on foot or by road using the Web App.

7. Indemnity

You agree to indemnify and hold the Municipality of Pozzallo and IMMAGINA ADV harmless from any claims, losses, or damages (including legal fees) arising from your improper use of the Platform or your violation of these Terms.

8. Dispute Resolution (ODR) and Jurisdiction

In accordance with EU regulations, consumer users can use the ODR (Online Dispute Resolution) platform for disputes related to online purchases: http://ec.europa.eu/consumers/odr/. Any legal dispute will be subject exclusively to Italian law and the jurisdiction of the Court of Ragusa.
